The plaintiff mother, in her twenties, gave birth to the plaintiff child in December 2003. She was treated by the attending obstetrician, nurse, and a third-year resident. The baby as born with a variant of the sickle cell disease known as Hemoglobin SC. The mother claimed that she was not informed of the results of the sickle cell test. The plaintiff mother contended that if she had been informed that the baby was a carrier of the disease she would have terminated the pregnancy.

The defendant claimed that the mother would not have terminated the pregnancy and that she told one of the defendant’s so in a post-partum visit. The defendant also claimed that the child’s disease was mild.
