April 2010 Legal Case Study

Failure to Timely Evaluate and Treat Teenager’s Abdominal and Groin Pain - Boy Had History of Torsion - Loss of Testicle - $200,000 Settlement.

The plaintiff, a teenager, had a documented history of testicular torsion when he was brought to the emergency room in December 2003. He complained recent onset of terrible pain in the lower abdomen with stabbing, intermittent pain as well as groin ache.

The emergency room nurse was informed of the history of torsion.

The plaintiff was not seen by a physician for almost three and one-half hours. When the plaintiff was finally treated, his testicle had a 750-degree torsion, was necrotic and required removal.

The plaintiff claimed that the delay in treatment caused the loss of the testicle.

According to a published account a $200,000 settlement was reached.
